The background of this paper that there is a lack unconnect between the Article 5 of the Law of the Republic of Indonesia Number 40 Year 2004 on National Social Security System with Article 18 paragraph ( 2 ) of Law - Constitution of the Republic of Indonesia 1945 makes the rules is not logic. The problem studied in this research is : How should the next setting on the authority of government (central) with the local government in the field of medical. To answer of considered problems the authors use the method of approach legislation. Based on the results of the study, the authors obtained the answers to the problems that exist, there should be a revision of Article 5 of the Law of the Republic of Indonesia Number 40 Year 2004 on National Social Security System, namely by giving authority to local governments to make the social security system prevailing in the area. Responding to the things mentioned above, the legislature should amend Article 5 of the Law of the Republic of Indonesia Number 40 Year 2004 on National Social Security System that better reflect the principles of autonomy.
